Mr Opinion

Re your question to me earlier this morning, at http://forum.onlineopinion.com.au/thread.asp?discussion=9359&page=0#315830

On legal actions against Trump after his incitement of insurrrection against the US Government (ie. Capitol (Parliament) Building). Its not up to an agency of the US (eg. FBI) to unseat a President. Its up to Congress (House and Senate) to unseat him.

Of options:

1. In this context at hand, the 25TH Amendment of the Constitution is for Disability. Trump isn't disabled.

2. IMPEACHMENT? Initially Impeachment by the US House of Reps may be a break on Trump's misbehaviour - but maybe not. Trump's previous Impeachment by the House didn't have much effect.

Getting Impeachment through the Senate would likely take longer than the 12 days before Trump steps down anyway. Impeachment might not even be passed by the Senate.

BUT

3. There may be an option of Censuring Trump under SECTION 3 of the 14th Amendment.

This is along the lines: no officer of the United States...engaged in insurrection...can hold any office, civil or military, under the United States or in a State.

If successfully used Trump could not ever again run President (in 2024 or any other time) or hold any other US or State office - see http://en.wikipedia.org/wiki/Fourteenth_Amendment_to_the_United_States_Constitution#Text

That last possibility is suggested by NYT columnist, David Brooks, here http://youtu.be/eSjlgSUn5sU?t=43m58s . Though Brooks says "Article 3" by mistake when it is really SECTION 3 of the 14th Amendment.

FEAR TRUMP WILL START MAJOR WAR TO EXTEND PRESIDENCY

Losing the House, the Election, the Presidency, the Senate, has tarnished Trump's self-proclaimed image of being a "Winner" and "Genius".

Regret for 364,029 Covid dead Americans does not pass Trump's lips. http://covid.cdc.gov/covid-data-tracker/#cases_casesper100klast7days

But what more can Trump wreck before 21 Jan (our time)?

Well quite a lot.

Say bombing or Cruise missiling IRAN. The last using the massive Cruise missile armed SSGN submarine already in the Persian Gulf, next to Iran. See http://asiatimes.com/2020/12/us-bulks-up-persian-gulf-presence-with-ohio-class-sub/

Or Trump may decide to start a War with CHINA (in Trump's reckoning) to extend his Presidency during an international emergency - that Trump, himself, creates.

Nancy PELOSI knows Trump's little peccadillos. So she has taken bold action.

Politico reports, 8 Jan, http://www.politico.com/news/2021/01/08/pelosi-trump-take-away-nuclear-codes-456529

"PELOSI ASKS JOINT CHIEFS ABOUT PREVENTING TRUMP FROM LAUNCHING NUKES"

The president is 'unhinged' and the nation must be protected from him, she wrote in a letter to colleagues.

House Speaker Nancy Pelosi spoke with [the Joint Chiefs Chairman, General Mark Milley] the nation's top military officer on Friday. [This was about] precautions in place to prevent President Donald Trump from ordering a nuclear strike

or conducting other military hostilities as Democrats seek his removal from office.

The stunning revelation came in a letter from the speaker to House Democrats outlining next steps following a violent breach of the U.S. Capitol on Wednesday by Trump supporters. Pelosi said she spoke to Joint Chiefs Chairman Gen. Mark Milley about guardrails in place that could prevent "an unstable president" from wielding the military or the country's nuclear arsenal...." Nothing should surprise us about Trump.

Yes Armchair I think you are right. The US constitution needs a rewrite.
It was written in the days when to get the vote count to Washington
someone got on a horse and road to Washington, perhaps a week or more away.
They updated the voting system but left it wide open to corruption.
Indeed some voting electorates do seem to have been fiddled.
It probably can't be proved one way or another now but the system is
very insecure.
And that is where their difficulty arises.
There have been sworn affidavits about what happened in some voting
places but all that has been swept aside as "non of our business".
No matter whether it would have made a difference as to who won
the accusation is still there and will haunt Biden for four years.

It will sit there as a running sore because it was never resolved.
Of such things are revolutions made.

I note Elon Musk has condemned Zuckerberg for deleting Trumps please for Peace and no violence, that was so blame could be placed on Trump for the breaking the security lines as the Left have posted on this thread. The Left are seeking Impeachment and arrests of those that were involved in entering the House. They never said a word about the breaches of BLM.

The USA voting just needs to be made compulsory and those that do not vote need a valid reason to be excused. The Same as Australia to be democratically acceptable.
