Good point: if a person holding a public office, uses that office to subvert the Constitution and incite rebellion, are they guilty of treason ? Or malfeasance ? And/or their estate is liable to financially compensate for any damage that they incite ? Is capital punishment still the remedy for such treason ? While Trump is POTUS treason against the US Government, of which Trump is the major office holder, sounds unconvincing.
But after Biden's Inauguration the floodgates of court cases against Trump may succeed eg.
