Taking QPS to small claims court??

Im just wondering if anyone has ever taken QPS to small claims court re wrongfully impounded your
Car etc and ur trying to recoup what that loss cost you. How did it go and how dod you go about doing it🤔?

I always wondered why Police who arrest someone aren't made responsible for the property of the arrested person.
Same goes for rescues when cars or boats etc are left behind & end up vandalised.

Under what circumstances was your car wrongfully impounded?

A description of events is necessary.

For example, were you parked in a tow away zone which are clearly marked.
Or were you doing burn outs .

It was reported stolen by someone who claimed they were a part owner. Cops took the car even with a receipt shown by me when i was pulled over. Wasnt charged with any offence so they kept it for 9 months until they decided it was time to put before a magistrate. Harveys towing also had no power to keep my vehicle yet thwy wouldnt release it either.

Assuming it was currently registered in your name, it had no defect notices attached, then you prove ownership of the vehicle with the appropriate registration papers and ID.
and you should be right to go.

Harvey’s towing are waiting for payment for the towing service. Until they get that payment they will be uncooperative.

If the police held the vehicle, there is a reason.

What reason did they give you, assuming you complied with the above?
