Now it has to be questioned, that if a person takes a job, finds that the very nature of the task (usually repetitive) is causing discomfort to a certain joint, limb etc, is it then fair to go on compo some years latter, knowing full well the injury was occurring.
Remembering of cause, that some people can perform the same tasks, or similar, for a life time and not be effected.
It is becoming all to common at present and in fact, I know of three people who are doing just that.
They complained about the soreness being experienced, yet continued in the job, which was obviously unsuitable to them, and are now on compo, and at least one is seeking a payout.
And of cause, as more and more of these cases exist, premiums increase, placing yet more pressure on employers, as the additional premium funds have to be found, often at the cost of jobs.
I would have to question their action, (employees) under the common insurance heading of 'duty of care' and ask if they are in fact in breach of their duty to inform the employer of the situation.
Perhaps employees need to sign a declaration at the commencement of each year, stating that they are not being effected by the tasks they are performing.
