A crime or offence is committed against you:

1/ Tell the perpetrator between you and him alone. If he listens, you have gained your brother

It actually says "Treat him like a pagan or tax collector" now.. that has teeth doesn't it ? Pagans, and tax collectors. Jews would not have fellowship with them, associate with them, intermarry with them.
