When you look at the words of the 4th Amendment to the US Constitution, you wonder how there could ever have been any doubt on the question:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

The problem is of course, if there is no negative consequence for the high officials who deliberately disobeyed the Constitution, then this kind of disgraceful abuse will just keep on happening. And of course this is only one example of many. What about the TSA in America, sexually assaulting anyone who wants to go by plane?

I've seen this in Australia where the Constitution, or an Act of Parliament, provide for limits on executive power, and the executive, even at the highest levels, just ignore it, because they know the victim of their abuses will fear the costs of taking the government to Court (quite apart from the fact that the judges are all officials of the State).

And this is why written Constitutions, in their current form at least, don't work - you're basically handing unlimited power to the most powerful and saying "limit yourself".

The Constitution needs to be amended so that anyone subject to it has a remedy in ordinary, exemplary and punitive damages against any official personally who breaches it, with the State to pay the costs of the litigation, and costs against the plaintiff for vexatious litigation. When the Ministers' and officials' own homes and fortunes are on the line, I warrant we'll see more respect for the rule of law.

I'm not sure how to judge Edward Snowden.
I'm not sure whether he's done the right thing.
I find it difficult to grasp the fact that he
was hired as a "Security" contractor and surely
he would have had to sign some sort of a
confidentiality agreement because he was privy to
secret intelligence documents. To release those
documents to the media must rate as an act of
disloyalty not only to his country but to his
employers. And the fact that he claims to have
done it because he found their actions "disturbing"
does not ring true. Surely, he should have
realised what he was getting into in the first place.
Just what did he imagine the NSA did? He may be
right that the NSA' mass surveillance programs
would not withstand a constitutional challenge and the
court has vindicated him - but it was his job to
maintain the privacy of the NSA - and he knew that
when he agreed to the job in the first place.
