Hard cases make for bad compensation laws : Comments

Should the community quietly accept the sweeping away of many of these basic protections, when it comes to a 'special case'?

Most compensation is a racket. Apart from instances where a person cannot work or provide for themselves due to an incident, there should be no monetary compensation, particularly where taxpayers have to foot the bill. Money will not assuage abuse, sexual, or any other form. Punishment of those causing hurt or offence is sufficient. Money is too often used to paper over cracks in society.

Of course some lawyers want the right to badger a young, vulnerable, traumatized witness restored.

Given this allows some evidence to be suppressed, particularly that given in the presence of the accused.

When officers of the court are honor bond to expose the truth warts and all, even where that exposes the defendant to who he/she really is!

That being so, I would welcome the deployment of covert, space age, unbeatable lie detection equipment!

Rigidly resisted as that would expose perjury by various defendants and or plaintiffs. When the goal is winning by any and all means!?

Even making the cost for the plaintiff prohibitively expensive, so the defendant can claim alleged validation!

Sometimes its easy to tell when someone is writting about something they have little or no experience with.
