In effect the plain packaging laws started from a relatively low base.

The agreement under which Australia is being sued in Hong Kong shows the danger involved in entering into agreements which reduce our government's ability to govern in the interests of our citizens.

Smoking is a proven health hazard. Citizens would be better off if the government legislated to ban any product which contains addictive ingredients. For those already addicted a methadone type supply system could be established.

If anyone thinks that is "nanny state" they need to consider how much the effects of smoking adds to our health budget. Why should non-smokers be paying for the health costs created by companies that are marketing, for profit, a dangerous product?

I agree with most of the comments above, but one important factor is overlooked. If the Government does as the author seems to suggest and reverse the decision on plain packaging, the case for compensation by the major tobacco companies would be overwhelming and we would be in for billions in compensation for the time when plain packaging was in force. Whatever the effectiveness of plain packaging, we have no alternative but to fight our corner for it in the international tribunals. Disclaimer - I worked on the plain packaging campaign for the Department of Health and Ageing in 2011.

I find it irritating when someone reads something into what I write and then tries to refute it while ignoring the actual point I was trying to make.

I was not trying to imply that only the Coalition had applied restrictions on tobacco, but that 11 years and numerous restrictions (far more than you listed) in this time considerably reduced the smoking rates, and the rate of drop in smoking has not changed notably since. The implication is that this packaging policy has not made a measurable effect other than annoying the manufacturers.

The restrictions brought in by Keating and Howard were done after serious research unlike the thought bubble packaging laws.

It is just so typical of all governments to stuff things up as they generally draw their talent from those who the corporate sector bypassed.

As an example, had the government back in 2010 or so said something like, from the year 2013, any wholesaler or retailer must posses a license to sell tabacco products and the license fee starts at $200,000 annually and increases as per the volume they sell.

This would have not infringed on the manufacturers rights, would not have caused the confusion plain packaging has caused in the retail sector and, as the fee would have most definitely been 'passed on' it would have curbed smoking. Of cause it would only have worked if they fixed the loople in the online GST fiasco.

What governments need to decide, is do they want to stop smoking, or don't they.

There are several angles they can choose that won't see them being sued.

They can ban smaokng from any public place, full stop.

They can ban smoking from all workplaces, full stop.

They can ban smoking from any clubs, full stop.

They can ban smoking from any moving vehicle, as dropping a lit smoke on ones lap would be far more distracting than using a mobile in hand while driving.

In fact, governments can ban smoking from anywhere other than a persons own private property so that the minute anyone steps out their gate with a lit cigarete they can be finned.

What I am saying is that IF GOVERNMENTS WISH TO STOP SMOKING there are ways to achieve this without being sued by cig companies.

While cig companies may have the rights to their trade marked advertising, which is what they are fighting for, they can not sue a government that either bans the sales, or, hides the product from view. It's the changing of the packaging that has caused the issue, nothing else.

As for public places, that referee to anywhere outside of ones personal home/yard.

As for the four meter rule, I thought it was 3, shopping centers are the winners out of this, as many charge or review their rents on traffic numbers and, if you have 300 smokers in the centre, and each exits for ten smokes a day, that's fudging the figures.
