BL's defence is based on the claim that sexual intercourse never happened ergo he could not have raped BH.

As BH refused to report this to the police or submit to the gathering of evidence, BH has no proof that sexual intercourse, consensual or otherwise occurred. This is back to the whole he said she said scenario, which as the high court showed leads to not guilty.

Unless the police have more corroborating evidence this trial is a non-starter.
