How can we remain unmoved when the very head of the beast,judges,lawyers,barristers,solicitors and huge numbers of hangers on such as utterly corrupt and worthless family consultant's/report writer's etc. but most notably the majority numbers of the democratically governed populace say it is a biased and broken system and still we allow our kids,our future be robbed of a loving,caring,competent and available parent(mainly dad's).
A conservative estimate of 3 suicides p/w in Australia are directly linked to the vile treatment handed out by this most uncaring, divisive fraud. Sure domestic violence is a scourge on society also but just as speed and alcohol was eventually linked to road fatalities, dare to delve into the sad figures available and I would dare to bet near anything, that you will find huge,huge numbers of offending directly related to again this broken system. Whilst demands are made of ordinary working class men to accede to the outdated pomp and regal ceremony that still exists within these hallowed ( often empty despite claims of being overwhelmed ), whereby the issue of whether he stood when a judge entered or his sunglasses are atop his head or heaven forbid he should dare be chewing a pellet of gum takes a massive back seat to administering justice there will remain a chicken or the egg conundrum regarding violence,conflict and anger.Tragically 1 man hanging himself as he is robbed of the greatest achievement of his past present or future existence,his god given right to become and grow into being a father is 1 too many. Equally so 1 man with no hope after being corruptly robbed by ruthless self serving legal reps. of his spiteful,hurt,vindictive or mentally unwell ex partner confronting his legally protected ex. is too many. How many incidents would be accounted for that involve a father/ex deciding to enact his parental responsibility to his kids after inviting a legal system to adjudicate naively and then screwing him over whilst unjustly allowing rules be not adhered to only by a judges learned friend and not a self repping dad. How many more that decide " she and I both know the true facts and not the lies spun in court,I lived with her for "x" amount of years,I know her if I can just sit and talk sense with her we can work it out for the kids"? Upon arrival is a newly yet falsely empowered ex pumped up with the false entitlements fed her by the money hungry lawyers who's interests were met by doing so only to leave her alone as a mere number and old case file after gaining her a spite driven ruling from his overly friendly judge .
How many of those occasions turn sour and become statistics. Again even 1 of, is too many. Whilst smoke and mirrors and a "chummy" environment in which to conduct such and all the while devaluing a fathers love and wish to parent a child may gain a "case closed" on the paperwork and a legal 'professional' 1 rung higher on his/her career path but human nature being as it is,the crime of stupidity is committed when that final gavel comes down expecting a decent hard working man to simply abide by a corrupt and blatantly wrong decision. Until we as a society say " Enough " of the legal pomp and self serving interests of the self acclaimed elite among us, " Enough" hiding behind the child's so called best interests when 'Blind Freddy' can see through that lie and " Enough " of ranking in importance a parents role until separation ,should as usually occurs, the man works to bring home $'s to provide for his brood so naturally a stay at home mum by default gets to create a closer bond with a newly arrived child. The people that utter such defamatory remarks within a courtroom have surely no idea how degrading a man is to feel that he is suddenly surplus to a child's future that he was proudly a pivotal part of last week. So as we fail to do anything to fix this putrid system & we tumble towards generations of fatherless kids and pseudo protected mother's with their immorally gained legal standing, I beg all of us to do something,anything to remedy this situation as once again we all know it's wrong,we all know it's happening,we all know the stories we hear are true but unlike our fellow man of days gone by please for the love of innocent kids let's not simply ignore this equally horrendous treatment of our most vulnerable.

I have witnessed a family member, a father, being torn apart by this very same system.
He was a kind, gentle model father to his two kids and now, after having his kids taken away from him through nothing more than lies from a vindictive bitch, he is a cold hearted man with no home (other than a room in his mums house)has very little money and given he is in his mid 40's, F-all chance of becoming the man he once was. The system is there to protect people, yet this bitch, through her lies has managed to have a restraining order placed on him and would even go out of her way to breach the boundaries herself, then blame him. Of cause the system allowed this to happen. I have to wonder just how many of these people in charge are man hating leso's with a personal axe to grind, stopping at nothing to see men demoralised to the point of worthlessness. As for the lawyers, their priorities are their money first, then see what we Can't do for the poor buggers who go through this on a daily basis. While I accept many men are far from perfect partners, one has to wonder about how many bad men have an evil vindictive woman behind them. And of cause, the welfare of the kids come last. Cheers for response brother. Sad part is we all know one of these blokes who is no more than a shell of his former self if indeed we are not that very bloke.
I am pretty much same boat as your mate- my only crime I could no longer live with the diagnosed medically unwell mother of our child whom I never as much as raised an eyebrow or my voice to & yet she is punished as much as I by being isolated from each other. This countries government and legals are aiding in the abuse of our kids whilst they sit and do nothing to fix the god damn elephant in the room ! Not another Royal Commission, please! We pay politicians more than amply to fix these problems. Get them on to it. A very costly commission on anything only recommends, and politicians are the only people able to act. Cut out the 'middle man'.

Hi there EXISMENTAL...
You've raised an interesting topic here, in the Forum today my friend. To be honest I've never had to appear before the Family Court but tales emanating from those august Rooms abound with rumours of immense distress, mendacity, and incredible manipulation to say the least. And to think that many of us having managed to calm a hitherto quite aggressive domestic dispute, have unwittingly advised the warring parties, to perhaps seek legal advice, makes me really cringe. As a copper when we attend a 'domestic' our first duty is to immediately stop any violence therein, and having calmed the protagonists down sufficiently, which does take time with repeat offenders, if we've managed to achieve that, our job's done and it's time to get the hell out of the place. 'Domestics' are among the least favourite of jobs, in the opinion of most coppers EXISMENTAL. My point being many police have no idea of the Family Law process and the deleterious effect it may have, on many who seek it's legal adjudication. Not realising how skewed the Act is in favor of females and/or the children, especially those who're seeking a remedy of a custody issue. Another interesting thought - Gay marriage if permitted ? Female to Female and Male to Male ? That will most certainly confuse our learned Justices presiding on the Family Law Bench ? A thoroughly interesting topic you've raised here EXISMENTAL. - Henry VI, William Shakespeare The old ideas are always the best ones. Although I don't know about killing all the lawyers, that seems a bit harsh. And my brother-in-law is a copyright lawyer. But by all means ban the buggers from Family courts and require people to represent themselves. The lawyers are only in it for the coin, and only have their own best interests at heart. Any political party that offers to reverse the injustice of the family law system will win lots of votes.
There needs to be a radical re-think. First question should be, why should government be regulating sexual or reproductive relations in the first place? So long as they are based on consent, there is no reason for government involvement. The current system forcibly imposes traditional patriarchal sex-roles - but only on men. Women have the benefits, provision, protection and privileges of both feminism and patriarchy, and men have the costs, risks, sacrifices, humiliation and tedium of both. Posted by Jardine K. Having been an unwilling participant in this vile arena masquerading as "savior of our kids" for a tick over 3 years now I can well attest to the fact it is designed and conducted as a conduit for conflict.I honestly believe it is run with cocked up rulings given in the hope of antagonizing dads to the point of giving up & walking away from kids,giving up on life or giving in to the natural human instinct to react to unjust controls being put on his life and lashing out at a system that cruelly robs his kids of a dad and force him to shut up & watch.
Matters in the FCCoA dealing with kids under the Family Law Act are supposedly conducted under Family Law rules,FCC rules and lawyers are meant to uphold the oath they uttered. The duty to the Court, and the administration of justice, is a lawyer’s most important duty.Put simply,Lawyers must not mislead or deceive the Court.B/S ! I can vouch that these expected standards do not exist and are ignored if a father then elects to run his case unrepresented by counsel. I have been bullied,provoked,belittled,fed lies and treated with utter contempt by a soulless gimp barrister representing my gullible,easily led ex partner. Rules governing disclosure,serving of documents by certain times have never been adhered to by this pig.To the point of I received their trial affidavit by courier the night before final trial. My protests get me labeled a liar amongst other crap and judge simply steamrolls over my oral protests. This pig painted me a certain way to court for over 18months that I repeatedly demanded he furnish the proof he must surely have to enable such claims be made. Completely ignored & pleas to judge & child's lawyer to take action were a combination of ignored,denied & held up as an example as to why I was apparently unhinged,violent,intimidating,controlling & basically scum & non parent material. Finally during trial 18 months after the lies were 1st painted & the court accepted & felt it's only option was to repeatedly hand down interim rulings that saw my time with my princess fully supervised in a contact centre for less duration than convicted criminals in jail are permitted with their kids as well as various other civil liberties stolen of me and child. A slip up occurred & lo and behold the very irrefutable document appears that 100% proves this pig mislead court for 18 months & sickeningly gained more ground by ridiculing & provoking my constant defense of my character. Thank god ! me exonerated,barrister charged? Yeah right ! I can't even get these clowns to now admit this document even exists let alone the ramifications that stem from it. Verdict stands,I am what he painted me as despite loud opposition to & valid real proof by tabled document that should exonerate me & have him charged with contempt.Nothing. Hi Exismental,
I'm sorry to hear of your troubles. As I'm sure you realise they're an all too common experience for a great many men and women. It's also true that not everyone chooses to act badly within the family law, even when it is easy for them to do so. Decent people work out that it's not worth their personal pain to sacrifice principles to vengeance or greed. Of course, as you're discovering, it only takes one to tango... Have you heard of the term "Mckenzie Friend"? It refers to the right of people who are appearing in court, especially Family Court, to have someone attend as a recognised supporter. http://www.mckenziefriends.com.au/guide-to-a-mckenzie-friend.pdf I suspect you could really use someone to act in that role. It's unfortunately also true that an angry man is much harder to feel sorry for than a teary female and you might find it useful to have someone who can act as a cool head or even just a sounding board when you're feeling stressed in court. I've found that the best way to stay out of Family Court clutches is to stick with the same woman. After 48 years of marriage, I'm not expecting any problems with them at all.

It would need to be a very wide ranging review, Royal Commission or otherwise.
At the heart of much of the grief is I think the way money and assets follow children with little relevance placed on the reality. Children become a thing to fight over with significant financial impacts on the outcome. As it has already been pointed out it often needs only one party wanting to play that game for the other to find themselves drawn into a nightmare. There are attempts at fairness in the rules with no process to try and achieve fair outcomes, seemingly rarely consequences for dishonest behaviour or obvious attempts to manipulate the system. Hey,thanks guys. Honestly, I don't think a lot of people realize just how hugely much it matters to a victim of this cesspool legal arena, when others simply recognize a hurting member's need & natural instinct to vent/release pent up toxic emotions. Every response to this thread has rethought my nearly diminished faith in fellow human's.
Oh & I never thought i'd ever hear myself utter the words,but..........Pauline Hanson..you stand to potentially forever change the political history & culture of this great country & ensure you're forever cheered. But only if you stick to your assured path as touched on in your maiden speech(well,2nd time around)& stay the course & cleanse & purge this entire tainted,grubby,corrupt family law system. I believe she has witnessed it's evil very closely & personally morally supporting her closest family members at some point in time. You're most welcome mate. The environment has changed a little over the past decade here on OLO. Back then any discussion of men facing problems with the Family Law was met with abuse from a small but vocal cabal of embittered women and a few cynical types who profit from the destruction.
The Family Law itself has also changed a great deal. Keep your spirits up, don't get drawn into pointless discussions and do your best to keep your dealings with her lawyers out of the gutter, although it's London to a brick that's where they will try to drag you. The legal profession and their hangers on in the professional "mediation" racket (yes, Relationships Australia, I'm looking at you) have very little to be proud of in their management of the process around family breakdown. Have we learned nothing as a collective society from this and the equally disgraceful " stolen generation " that stamped all of humanity as utter failures at decency,logic, and ethical high standards, to name but a few.
I seriously ask how we, as an apparently intelligent race of supposedly compassionate people can sit idly by whilst the next tragedy is mindlessly inflicted once again on the most vulnerable of our race.
When such huge numbers of general populations quickly align in numbers that state they believe the Family Law system is broken/prejudicial/corrupt and nothing more than a money generating ruse to benefit the huge list of grubs who's self serving interests are met by prolonging,encouraging,exaggerating and even flat out inventing conflict between their client and the clients now ex partner.
Look hard and deep enough and one will find results from polls/surveys of these very antagonists who will even disclose themselves that the system is failing our kids. Still nothing remotely close to addressing the problem is the outcome.
Even the recently retired Head of the combined registries of both Family court and Federal Circuit Court seemingly couldn't contain his golden handshake produced disbelief when on leaving his post admitted as much.
In a seemingly " catch me if you think you can " moment worthy of a skit in an old Benny Hill episode, he then had the audacity to lay blame on outdated computer systems.
These same "outdated systems" that he oversaw for the previous 8 or so tears , I believe.
Off he shot on the Family Law system's fastest milk-cart in the west !
