Wrongful Speeding Prosecutions in Queensland

Nearly anybody in Queensland knows someone wrongly convicted of speeding. It has just happened to me. I was sent a notice with a photo taken across the central reservation between two bushes with a lamp post almost centre shot showing two cars side by side. Mine on the speed limit, the other overtaking me. As he was nearly 20Km/H over the limit that's 3 points they want give me. Any other country such "evidence" would be laughed out of court, but here it might be extremely foolish for me to contest it. I am given to understand I probably won't get my costs back even if I win, and if I don't then I get stuck with police costs too and an increase in penalties. And it may not stop there. A relative of my stepchildren was also wrongly done for another's speeding, but when he contested it, he was pulled over almost every time he was seen by a police vehicle on any pretext they could think of until he dropped the case. Just last night I was told by a friend of my stepchildrens family that he also was done. Two vehicles in shot travelling in opposite directions, but, presumably because his was the vehicle nearest the edge of the shot, he received the conviction even though he was on the speed limit, without hope of contesting it. My wife, a few years back, was following her ex and his partner when an officer leapt out so close in front of the front car he had to swerve to avoid him, so instead my wife was pulled over, but for some reason it took 15 or 20 minutes for him to finally come back with a radar gun showing an offence. This is all wrong, but what can be done about it? Especially as the Queensland police think they are above the law. For myself, is there anyone out there who knows where I can find regulations relating to the siting of cameras in Queensland? It might help me fight this injustice.

What can I say? We just cannot have ANY confidence in the police to do the right thing by us. This is especially true at the minor end of the infringement spectrum, particularly with road rules.

I’ve been through the situation of having a police officer brazenly cop me for a driving infringement that he knew wasn’t true, in order to protect a mate… and when I chose to take it to court, of the local magistrate upholding that charge, despite absolutely no proof or credible evidence of any wrongdoing on my part! The police know what they can get away with. The system is set up to very strongly discourage people from questioning police decisions. Consequently the police know they can get away with a lot more than they would otherwise.

I would have thought that a fundamental part of the policing of road rules and the improvement of road safety would be the development of a high level of confidence in the police, to do their job impartially, in line with the law, with the right motives and with the proper use of their wide discretionary powers.

I went web-surfing for information on speed cameras in Qld. But I ended up just getting shunted around in circles and finding NOTHING!

My understanding of NSW rules is no fine would be given if two cars appeared in the photo.
However I would like to go on record here saying our traffic police can not be trusted.
Some years ago an inquiry was held into police corruption in this state.
Evidence was given of police working for tow truck drivers and even while on duty booking the owners and their family's of other tow trucks.
A request from those they worked for when of duty.
Truck roll overs saw freight stolen ,sometimes using hired trucks to take it away!
After the investigations many left the force a very few got thrown out, few indeed .
And a few remain even now, but the new recruits have bought a new culture that is dreadful to the job.
A smart Alic I can do whatever I want attitude made even more unpalatable when it is from a young lady out to prove her worth.
I want to make it clear a good cop is worth much more than the community can afford to pay him/her
But it is sometimes hard to find them among the growing ego driven fools in police uniforms.
