Judges who think they know better : Comments

By David Leyonhjelm, published 25/5/2026

The doctrine of separation of powers is central to Australia’s constitutional system. Parliament makes laws, the executive administers them, and the judiciary interprets and applies them.

Judicially active judges should be sacked. Their latest effort that the law outranks science and biology in differences between men and women is outrageous.

The other political adventures indulged in by judges referred to by the author are also outrageous.

The political class won't do a damn thing about activist judges because they take the heat of themselves.

Some simply want judges who agree with them, Trump is a prime example, appointing people to the American Supreme Court that vote in accordance with Trump's agenda.

In the case Senator Hanson-Young brought against Leyonhjelm, it was proven Leyonhjelm had defamed Hanson-Young outside of parliament on two occasions Leyonhjelm was ordered to pay $120,000 in compensation, end of story. Did Leyonhjelm think as a senator himself he had the right to run around the countryside defaming people? Maybe that's why Leyonhjelm got booted from parliament.

I'm very perplexed as I was always led to believe that Judges are impartial, knowledgeable, intelligent, reasonable & fair however, since I've witnessed that to not be so I'm wondering how they could be retrained to adopt these values ?

we are not far behind UK where activist judges are largely responsible for tens of thousands of young girls being raped. To this day they go very light on the protected class. No difference from the activist judges in Victoria where they were happy to gaol innocent people and let the usual suspects off free. Hopefully the awakening of the people might change things however I suspect sick leftism doctrine has so infiltrated through the whole bureaucracy that it would take a revolution.
